Analysis of the World Anti Doping Agency (WADA) Success Sports, Leisure and Coaching Law Examine the success or otherwise of the WADA Code with regard to the regulation of the use of drugs and doping in sport It is submitted that the World Anti-doping Agency (WADA) has achieved a reasonable measure of success in the pursuit of its mandate to establish a drug free sports world. WADA, both in its structure and in its execution of its policies, is not presented as a perfect mechanism in this respect. There are also well articulated contrary philosophical positions concerning whether sport, particularly at a professional level, ought to be regulated for substance use at all. That question is beyond the scope of this paper. In the present review, WADA is presumed to be acting at all times as a legitimate agency to advance the broad public interest in safe and drug free sport. A brief definition and over view of WADA’s structure shall assist in the appreciation of the points made in support of the opening statement above. WADA was founded in 1999 at the instigation of the International Olympic Committee (IOC) and its member bodies in the wake of a number of well publicised doping scandals (Canadian sprinter Ben Johnson’s positive steroid test in the 1988 Olympics; the Festiva cycling team arrest at the 1998 Tour de France are two examples), WADA is the supreme authority with respect to both the establishment of proper test procedures and the determination of what substances will be the subject of athletic sanction when detected (Lerner, 2006; WADA, 2007). The WADA Code outlines the broad goals of the agency. The Code is the primary regulatory instrument employed to forge an international consensus concerning anti-doping practices in sport. The Code is the structure that binds sports governing bodies, national Olympic committees, and independent sports leagues to the enforcement of the WADA rules concerning doping tests procedures, both in-competition and out of competition, in conformity with the annual WADA Prohibited List of restricted substances and those subject to therapeutic exemption (WADA Code, 2) This background information is emphasised because it confirms one important yardstick by which to measure WADA success the critical mass that WADA has achieved since 1999 in assembling a broad membership of the world sports community that supports the anti-doping mandate, and the corresponding elevation of various doping issues and the inherent dangers of substance abuse in the public consciousness. This success, while somewhat intangible, is arguably as important as any specific drug testing programme or the successful pursuit of sanctions for doping violations. On a related basis, breaches of the WADA Code by athletes are now generally publicly perceived as more than mere transgressions – drug cheating and its ‘win at all costs’ mentality tend to create a negative image of the offender in the eyes of the fan. One example is drawn from the otherwise staid confines of international cricket; Australian star Shane Warne’s use of a banned diuretic was widely described as ‘†¦ the single biggest disappointment’ in the 2003 World Cup. (Mangan, p. 228) The WADA Code has been held to be in conformity with the generally accepted principles of international law in most respects (WADA Code, 2007, 2). The WADA Code provides for a strict liability regime concerning the presence of a prohibited substance in an athlete, the automatic disqualification of the offender from the subject event, and the imposition of a suspension; all such measures have been deemed to accord with fundamental international law principles, primarily due to the various provisions that permit an aggrieved athlete to apply for a hearing to seek an appropriate remedy by way of arbitration. (Kaufmann-Koehler, 2003, 3) The legal issues generated by the prevalence of doping in sport must be understood from several distinct perspectives. The first is the subsisting importance of the national or state criminal law regarding the possession, use or distribution of illegal substances. The fact that a stimulant such as cocaine is used by an athlete to enhance performance does not exclude the possible intervention of the state criminal law authorities upon its detection in the athlete’s system.(see Ulrich, below) In practice, the apparent acceptance of WADA styled enforcement in sports as excluding the intervention of the state is an interesting phenomenon. The effectiveness of WADA has created the undeniable impression that ‘sport crime’, in the sense of prohibited substances and a violation of the WADA ‘play clean’ mandate is an administrative sanction issue for the particular sport league or governing body, not a matter for the criminal law. A state criminal investigation may create an opportunity for WADA to intervene, or alternatively, to seek the production of search and seizure results from the state authority; the German police investigation into Tour de France cyclist Jan Ulrich and the 2007 Spanish criminal inquiry regarding doping products and public safety are examples (WADA Code, 3). Once in receipt of such evidence, WADA have successfully instituted proceedings pursuant to the Code against athletes targeted by state authorities; challenges to prohibit this approach by way of injunction have failed (Balco, 2006, 1). Distinct legal issues are engaged at three different points on the continuum mandated by WADA anti-doping procedures the testing, the analysis of the test results, and the appropriate sanction to be imposed. This continuum has created a definable body of administrative law that has mirrored the emergence of a global administrative law trend wherever private international bodies such as WADA possess authority. (Kingsbury, 2005, 16) Notwithstanding the attacks that have commonly been advanced against the process, a further indicator of over all WADA success is the perception of transparency concerning its practices and the corresponding heightening of confidence that WADA and its constituent organisations adhere to their own Code. Prior to the institution of the WADA Code, a common tactic for an athlete who was subject to sanction as a result of a positive doping test was to seek a civil injunction. In an era of less than standardised practices, such injunctions were routinely granted, as courts often stated that they would not see an athlete deprived of their ability to earn income on the basis of flawed testing or administrative procedures. (See Reynoldsv. IAAF, 1994) The Court for Arbitration in Sport (CAS) is now the primary vehicle for the determination of all international WADA related proceedings; most national and affiliated sports organisations have established similar arbitration mechanisms. (Pound, 2006, 113) A recent example of the reluctance of national (or supranational) courts to interfere in WADA-based proceedings is revealed in the Meca-Medina decision. Meca-Medina was an European Court application seeking to declare the IOC rules governing doping control (as propounded in the WADA Code) to be incompatible with European Community rules (EC Articles 82, 83) that regulate competition and freedom to provide services. (Meca-Medina, 2006, para 1, 4) The appellants were long distance elite level swimmers who had tested positive for a prohibited substance, (nandrolone) in post-event testing and each was subsequently suspended from competition for 4 years. The appellants had appealed the suspension to the CAS and each was unsuccessful before the arbitrator regarding the merits; the suspensions were reduced to 2 years. The European Court held that the economic interests of the appellants were secondary to the legitimacy of the anti-doping initiatives and the absence of any procedural irregularity on the part of the sport organisations involved. (Meca-Medina, para 58, 60) The CAS was founded in 1984 as an arm of the IOC. It is an unquestioned high level repository of sports administrative law expertise (over 200 cases per year with arbitrators drawn from over 80 countries; alleged WADA Code violations are a significant percentage of the case load). As with civil law arbitrations, the CAS acquires its jurisdiction by the mutual consent of the involved parties, where all decisions are final and binding (subject to extremely limited rights of review). (Lerner, 81) It is submitted that the definable body of sports law generated in CAS anti-doping proceedings is a further hallmark of WADA’s continued legitimacy and success. The primary focus of WADA’s anti-doping efforts is directed towards individual athletes; the Code extends to all persons involved in athlete support – coaches, trainers and medical personnel. The long and intricate machinations of the United States criminal investigation into the Bay Area Laboratory Co-operative is an example where support persons were implicated in the supply of steroids to Olympic champion sprinter Tim Montgomery and American baseball record holder Barry Bonds. (Balco, 2006, 1) The range of cases heard by the CAS reflects the breadth of the sporting world itself. The CAS has been called upon to consider reduced competition bans where extenuating circumstances are urged by the athlete (Lukin, 2007, 3); a request for relief from the Prohibited Substance list on the basis that the particular substance will aid in the health of the athlete (Brockman, (2004), 1); where an alleged tampering with a out of competition urine sample test procedure was challenged (Boyer, 2004, 1). A recent decision of the CAS that highlights the CAS interpretation of the strict liability rules of the WADA Code is that of Zach Lund, the American skeleton racer disqualified from participation in the 2006 Winter Olympics due to a positive test for a prohibited masking agent, finasteride. (Lund, 2006, 1,2) The uncontested evidence before the CAS was that Lund had finasteride in his system due to his long term use of a hair restorative product. The CAS held that Lund was â€Å"open and honest† in his description of his failure to take all appropriate measures to educate himself as to the risks.(Lund, p.8) It is submitted that in a traditional civil injunction proceeding, the absence of intent to gain a competitive advantage might be determinative of the issue, given that a berth in an Olympic Games was at stake. However, consistent with the ‘new age’ of anti-doping attitudes, the CAS held that ‘†¦the burden on the athlete to establish no fault or negligence is extremely high†¦Ã¢â‚¬â„¢ (Lund, p.9) The arbitrator ruled that Lund was banned from Olympic competition in 2006. In a 2006 arbitration conducted by the international basketball body, FIBA, a similar imposition of the WADA Code mandated and exacting strict liability standard was imposed for the inadvertent use of a hair restorative (Kurtoglu, 2006, 1), where FIBA upheld a two year competition ban. Other fact situations that highlight the primacy of the WADA Code in modern sport are contained in the newspaper articles excerpted below.( e.g. Gatlin; Ferdinand; Chambers) In its eight years of existence, WADA has successfully impressed its anti-doping will upon the international sport community. The rules developed and disseminated by WADA have created cohesion and significant consistency in the manner that doping cases are conducted world-wide. As noted in the opening paragraph above, the intangibles associated with WADA’s heightened promotion of the ethical, health and competition issues inextricably linked to performance enhancing substances are WADA’s greatest achievement. Creating Hyperlinks :: Computer Science

Creating Hyperlinks To insert the button I clicked on insert-interactive images-flash button when the options screen came up I entered information such as; style, background color, button text, font, link, target screen and then name of the button. I then clicked OK. Creating Hyperlinks To link between pages I needed to create hyperlinks, to do this I first wrote the text that I wished the hyperlink to display I then highlighted it and entered the link into the box that appeared I then pressed enter Entering text To enter the text on my site I simply clicked where I wanted it to go and typed it in, I also changed the properties of the text i.e. alignment, color, size, bold, format, etc by highlighting the text and using the toolbar. Accuracy To check the accuracy of my work, e.g. all of my links worked and that there were no spelling errors in the pages I got my friend to read through the page for spelling errors and dead links. Here is a spelling error that was found. and here is the correction Back-up saving To ensure that I dint lose any work if the computer crashed I regularly saved my work, I did this by clicking on the file menu and then "save all frames" or "save" button depending on which file page I was working on. I have provided screenshots below of the buttons I used. I also saved it onto a cd incase the computer was damaged and the work was lost. Spelling and grammar checking To make sure that there were no spelling or grammatical errors on my site I copied the text into word and spell checked it. Carl Rogers (1902-1987) was a humanistic psychologist who agreed with the main assumptions of Abraham Maslow, but added that for a person to â€Å"grow†, they need an environment that provides them with genuineness (openness and self-disclosure), acceptance (being seen with unconditional positive regard), and empathy (being listened to and understood). Without these, relationships and healthy personalities will not develop as they should, much like a tree will not grow without sunlight and water. Rogers believed that every person can achieve their goals, wishes and desires in life. When, or rather if they did so, self actualization took place. This was one of Carl Rogers most important contributions to psychology and for a person to reach their potential a number of factors must be satisfied. Self Actualization â€Å"The organism has one basic tendency and striving – to actualize, maintain, and enhance the experiencing organism† (Rogers, 1951, p. 487). Rogers rejected the deterministic nature of both psychoanalysis and behaviorism and maintained that we behave as we do because of the way we perceive our situation. â€Å"As no one else can know how we perceive, we are the best experts on ourselves.† Carl Rogers (1959) believed that humans have one basic motive, that is the tendency to self-actualize – i.e. to fulfill one’s potential and achieve the highest level of ‘human-beingness’ we can. Like a flower that will grow to its full potential if the conditions are right, but which is constrained by its environment, so people will flourish and reach their potential if their environment is good enough. However, unlike a flower, the potential of the individual human is unique, and we are meant to develop in different ways according to our personalit y. Rogers believed that people are inherently good and creative. They become destructive only when a poor self-concept or external constraints override the valuing process. Carl Rogers believed that for a person to achieve self-actualization they must be in a state of congruence. This means that self-actualization occurs when a person’s â€Å"ideal self† (i.e. who they would like to be) is congruent with their actual behavior (self-image). Rogers describes an individual who is actualizing as a fully functioning person.  The main determinant of whether we will become self-actualized is childhood experience. The Fully Functioning Person Rogers believed that every person could achieve their goals wishes, and desires in life. When they did so self-actualization took place. For Rogers (1961) people who are able be self-actualize, and that is not all of us, are called fully functioning persons. This means that the person is in touch with the here and now, his or her subjective experiences and feelings, continually growing and changing. In many ways Rogers regarded the fully functioning person as an ideal and one that people do not ultimately achieve. It is wrong to think of this as an end or completion of life’s journey; rather it is a process of always becoming and changing. Rogers identified five characteristics of the fully functioning person: 1. Open to experience: both positive and negative emotions accepted. Negative feelings are not denied, but worked through (rather than resort to ego defence mechanisms). 2. Existential living: in touch with different experiences as they occur in life, avoiding prejudging and preconceptions. Being able to live and fully appreciate the present, not always looking back to the past or forward to the future (i.e. living for the moment). 3. Trust feelings: feeling, instincts and gut-reactions are paid attention to and trusted. People’s own decisions are the right ones and we should trust ourselves to make the right choices. 4. Creativity: creative thinking and risk taking are features of a person’s life. Person does not play safe all the time. This involves the ability to adjust and change and seek new experiences. 5. Fulfilled life: person is happy and satisfied with life, and always looking for new challenges and experiences. For Rogers, fully functioning people are well adjusted, well balanced and interesting to know. Often such people are high achievers in society. Critics claim that the fully functioning person is a product of Western culture. In other cultures, such as Eastern cultures, the achievement of the group is valued more highly than the achievemen t of any one person. Personality Development Central to Rogers’ personality theory is the notion of self or self-concept. This is defined as â€Å"the organized, consistent set of perceptions and beliefs about oneself†. The self is the humanistic term for who we really are as a  person. The self is our inner personality, and can be likened to the soul, or Freud’s psyche. The self is influenced by the experiences a person has in their life, and out interpretations of those experiences. Two primary sources that influence our self-concept are childhood experiences and evaluation by others. According to Rogers (1959), we want to feel, experience and behave in ways which are consistent with our self-image and which reflect what we would like to be like, our ideal-self. The closer our self-image and ideal-self are to each other, the more consistent or congruent we are and the higher our sense of self-worth. A person is said to be in a state of incongruence if some of the totality of their experience is unaccept able to them and is denied or distorted in the self-image. The humanistic approach states that the self is composed of concepts unique to ourselves. The self-concept includes three components: Self worth (or self-esteem) – what we think about ourselves. Rogers believed feelings of self-worth developed in early childhood and were formed from the interaction of the child with the mother and father. Self-image – How we see ourselves, which is important to good psychological health. Self-image includes the influence of our body image on inner personality. At a simple level, we might perceive ourselves as a good or bad person, beautiful or ugly. Self-image has an affect on how a person thinks feels and behaves in the world. Ideal self – This is the person who we would like to be. It consists of our goals and ambitions in life, and is dynamic – i.e. forever changing. The ideal self in childhood is not the ideal self in our teens or late twenties etc. Self Worth and Positive Regard Carl Rogers (1951) viewed the child as having two basic needs: positive regard from other people and self-worth. How we think about ourselves, our feelings of self-worth are of fundamental importance both to psychological health and to the likelihood that we can achieve goals and ambitions in life and achieve self-actualization. Self-worth may be seen as a continuum from very high to very low. For Carl Rogers (1959) a person who has high self-worth, that is, has confidence and positive feelings about him or her self, faces challenges in life, accepts failure and unhappiness at times, and is open with people. A person with low self-worth may avoid challenges in life, not accept that life can be painful and unhappy at times, and will  be defensive and guarded with other people. Rogers believed feelings of self-worth developed in early childhood and were formed from the interaction of the child with the mother and father. As a child grows older, interactions with significant others wi ll affect feelings of self-worth. Rogers believed that we need to be regarded positively by others; we need to feel valued, respected, treated with affection and loved. Positive regard is to do with how other people evaluate and judge us in social interaction. Rogers made a distinction between unconditional positive regard and conditional positive regard. Unconditional positive regard is where parents, significant others (and the humanist therapist) accepts and loves the person for what he or she is. Positive regard is not withdrawn if the person does something wrong or makes a mistake. The consequences of unconditional positive regard are that the person feels free to try things out and make mistakes, even though this may lead to getting it worse at times. People who are able to self-actualize are more likely to have received unconditional positive regard from others, especially their parents in childhood. Conditional positive regard is where positive regard, praise and approval, depend upon the child, for example, behaving in ways that the parents think correct. Hence the child is not loved for the person he or she is, but on condition that he or she behaves only in ways approved by the parent(s). At the extreme, a person who constantly seeks approval from other people is likely only to have experienced conditional positive regard as a child. Congruence A person’s ideal self may not be consistent with what actually happens in life and experiences of the person. Hence, a difference may exist between a person’s ideal self and actual experience. This is called incongruence. Where a person’s ideal self and actual experience are consistent or very similar, a state of congruence exists. Rarely, if ever does a total state of congruence exist; all people experience a certain amount of incongruence. The development of congruence is dependent on unconditional positive regard. Carl Rogers believed that for a person to achieve self-actualization they must be in a state of congruence. According to Rogers, we want to feel, experience and behave in ways which are consistent with our self-image and which reflect what we would like to be like, our ideal-self. The closer our  self-image and ideal-self are to each other, the more consistent or congruent we are and the higher our sense of self-worth. A person is said to be in a state of incongruence if some of the totality of their experience is unacceptable to them and is denied or distorted in the self-image. Incongruence is â€Å"a discrepancy between the actual experience of the organism and the self-picture of the individual insofar as it represents that experience. As we prefer to see ourselves in ways that are consistent with our self-image, we may use defense mechanisms like denial or repression in order to feel less threatened by some of what we consider to be our undesirable feelings. A person whose self-concept is incongruent with her or his real feelings and experiences will defend because the truth hurts. It is not a condition in which the individual is adjusted or fulfilled or actualized. Relationship between the Geography of Canada and Its History Veronica Guerrero FarJat CDNS 101 Royal Roads University Ms. Michelle Hardy November 20, 2013 What is the relationship between Canada's geography and its history? According to M. Hardy, (personal communication, March 27, 2012) my course material (2013) establishes that Canada is a North American country with 10 provinces and 3 territories; worldwide appointed as the 2nd largest country in the world Canada, is well known by its diverse but fascinating history! Canada fought over by the French and the British, the British won and end colonizing this one.This essay analyses the diversity of Canada's early history of settlement related to its geography. In order to see the connection we comprehend how the aboriginal people first came to Canada by following the wildlife; then the Europeans came to Canada because the vast of natural resources; and finally allowing the French people to settle in Quebec province. This paper argues that historical settlement of Canada was transformed by its geography. Canada used to be named â€Å"Kanata†: Huron- Iroquois word for village or settlement. In order to survive, as human beings we do many things such as feed, socialize, we procreate, we follow†¦ t mostly we stay together and we fight to survive. On this paragraph I will explain in detail how Aboriginal people first settle in Canada by following the wild life: Firstly, the earth warmed up, the ice masses melted and receded; which it means: open migrations routes (corridors). Following this fact, animals were capable to cross land bridges of the Alaska-Bering. Secondly,Aboriginal people appear in Canada's history by spreading out into the in abi n table areas ot north-western America, everything for huge reason: FOOD! They had to acquire certain skills such as hunting, fishing, etc. n order to survive. But animals; were their ain reason of settlement so then they stay and spread across the land. To conclu de I would like to point that as the climate and land conditions changed the land start to became rich and productive; natives were able to stay and that is one of the most important reasons how those first peoples are crucial for Canada's history; they represent thousand years of culture and wherever people nowadays agree or not they are Canada's first peoples. When two worlds meet, amazing things happen.According to my course material (2013) 1500-1791 was the time when Aboriginal people and Europeans were in contact. When Europeans first came to Canada, they ere amazed on this area because of the vast of natural resources; for example, wood/lumber that they could use in Europe so it can help with the development of their country. Firstly, Henry the VII financed an exploration to North America headed for the Italian explorer John Cabot in 1497. But it wasn't until 1610 when the English settlement begun. As tension set between France and England in Europe, competition leaded in the Americas.Subsequently, Henry IV of France assigned Samuel de Champlain to explore the new lands in the Americas; Champlain is an important figure in Canada's history because he opened up the St Lawrence River nd stretched French influence through the great lakes basin. As well, Champlain was involved with a group who were interested in the fur trade; the French and Aboriginal people collaborated in the vast fur trade economy. The fur trade was a trade between the French and first nation people for the exchange on items such as tool (beaver) and weapons. The short hairs of the beaver were used for making fashion hats and those were sended to Europe.In conclusion, the Fur trade had formed an important part of the early economies of both the English and French colonies and is very significant for Canada's early history because it's Canada's first conomy developed because of the beaver; which is a natural resource, this one and the wood/lumber are the two greatest examples why Europeans were so interested in this land so they are part of Canada's early history and we see the connection based on their decision after all happened deciding to settle here and so they end colonizing this country.On the early years of Jacques Cartier's France had been building up a colony along the ST Lawrence River. Conflict between France and England had been building up since then; European confrontations spilt over into the new world and in 1629 Kirke of England ended the French colony of Port Royal. This set the stage for opposition between the English and The French not only in the America's but also across the world. As I point in the beginning, Canada's is the 2nd largest country in the world.So now knowing that Canada is such a big country people is required for its development so after all the British conquered the former French colonies, absorbing them into their North American territories. Nevertheless, the French settled primarily in what is today known as Quebec and Nova S cotia. Britain allowed the French to stay because they needed them to settle this country; s well, Britain supported Canada with immigrants and money. Finally, once Canada had become a country, the goal was to unify, define, and built a state.This does not mean that the French Canadian renounce their mindset as Canadian or that they torgot their traditions and heritage. French was made the 2nd official language ot government in order to maintain French political support. I would like to emphasize that having all those facts and Canada being such a big country is essentially linked to its history bringing immigrants and the Europeans settling in this country. A omparison of Canada's history and geography; Mexico is diverse and it has 3 thousand years of history.According to world history project (2007) The Republic of Mexico is huge, comprising nearly two million square miles of coastline, desert, rain forest, mountains, and fertile plains. As Canada, Mexico is named as the 4th large st country in the western hemisphere and is rich in natural resources such as oil and natural gas. From the American borderlands of the extensive, agriculturally rich north, the country narrows gently as it sweeps south and east. As well as Canada, is bordered by the United States.In Canada's history we understand in some point the need of people while in Mexico there is a City (Mexico City) that is considered one of the most populous cities in the world. The population in Mexico is around 120. 8 million peoples. Although Mexico and Canada are very different countries, they have somehow things in common such as history of colonization. Canada was colonized by the British in the other hand, Mexico was colonized by Spain. Both, British and Spain were amazed by Canada's and Mexico's landscape, their beauty and its natural resources.Finally, Canada and Mexico are two greatest countries and somehow their istory and wealth on natural resources motivated other countries such as Britain and Spain to gain interest on them and that's how their history is similar. In conclusion, Canada is a land of diversity, creativity and liberal attitudes. The Canadian people are a mosaic of ethnicities; it means that as well it's formed by other nationalities which together they form a great home.We understand the connection by first, historical settlement of aboriginal people in Canada by following wildlife. Secondly, Europeans came and settle because of Canada's vast of natural resources nvolving the fur trade as a firs economy developed and finally, settlement of French people over Quebec province because of Canada's size and need of people. To conclude I would like to quote something that Lorraine Monk an editor of â€Å"Canada the Things We Hold Dear†: An Album of Photographic Memories (1999) said: â€Å"The search for Canada is a personal Journey.The search for a national identity is a Journey without an end. It began a long, long time ago. It will continue into the far distant future.
